Pricing API terms of use

1. Who these terms are between

These terms are between Medical Price Online ("MPO", "we") and the person or organization that creates an API key ("you"). By creating a key or calling the API, you accept these terms. If you accept on behalf of an organization, you confirm that you can bind it.

2. What the API provides

The API provides figures MPO computes from market observations ("the Data"): product identity, prices, price ranges, source counts, price history, category summaries, and title-to-product matching. The Data does not include the underlying listings, sellers, or any personal information, and we do not provide them through the API.

3. Your account and keys

You need a verified Medical Price Online account, and you are responsible for activity on your account and keys. Keep your keys secret and use them only from your own servers, never in a web page or mobile app that others can inspect. If a key is exposed, revoke it at once in the Developer area. We may revoke a key or suspend an account that breaks these terms or threatens the service, and we will tell you why unless the law or an ongoing abuse prevents it.

4. Plans, limits, and payment

Each plan has a monthly request allowance and a rate limit, shown in the Developer area. Requests over a limit are refused until the limit resets or you upgrade. Paid plans are billed monthly in advance through our payment processor, Stripe. Price changes take effect at the next billing period, with at least 30 days' notice. If a payment fails and is not resolved within Stripe's retry period, your account moves to the free plan. Complimentary plans are granted at our discretion and can be withdrawn with 30 days' notice.

5. How you may use the Data

You may use the Data inside your own products and services, including showing individual prices to your users, and you may store the Data you receive for the life of your subscription and refresh it through the API.

You may not resell, sublicense, or redistribute the Data in bulk, or offer it as a dataset, feed, or API of your own; use it to build or improve a database or service that competes with MPO's pricing; scrape the Medical Price Online website, or get around the API's limits with several accounts or keys; or present the Data as a certified appraisal, valuation, or guarantee of any price.

6. Attribution

When you show a price from the Data to your users, show "Price data: Medical Price Online", with a link to the product's Medical Price Online page where practical.

7. Accuracy

Prices are statistical summaries of asking prices observed in the market. They are not appraisals, offers, or the prices of completed sales. Each product reports how many sources its price rests on, and figures that rest on few sources are indicative only. We work to keep the Data accurate and current, but we do not promise that it is complete, correct, or fit for any particular purpose. Decisions you make with the Data are your own.

8. Availability and changes

We aim to keep the API available but do not promise uninterrupted service. We version the API (/api/v1/) and will give at least 90 days' notice before removing or changing a field in a way that breaks existing integrations. We may change these terms. Material changes take effect 30 days after notice to your account email, and continuing to use the API after that means you accept them.

9. Privacy

The API returns no personal information. We process your account details and API usage records to provide the service and bill you, as described in the Medical Price Online privacy policy.

10. Ending

You can stop at any time by cancelling your plan and revoking your keys. We can end your access under section 3, or with 30 days' notice for any other reason. When access ends, you must stop using Data that is not already part of your own outputs; you may keep figures already shown to your users in normal operation.

11. Limitation of liability

THE API AND THE DATA ARE PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND. UNDER NO CIRCUMSTANCES SHALL MPO BE LIABLE TO YOU FOR INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF USE, PROFITS, OR DATA, ARISING DIRECTLY OR INDIRECTLY FROM THE API, THE DATA, OR THESE TERMS. IN NO EVENT SHALL MPO'S LIABILITY FOR ANY CLAIM EXCEED THE FEES YOU PAID FOR THE API IN THE 12 MONTHS BEFORE THE CLAIM.

12. Governing law and venue

These terms are governed by North Carolina state law. The exclusive venue and jurisdiction for any dispute is the state or federal courts for Raleigh, North Carolina, as in the Medical Price Online Terms of Service.
